1. Acceptance of Terms

By accessing or using Railtor.ai (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Railtor.ai is an AI-powered workspace for real estate professionals and consumers. The Service includes tools for market analysis, lead management, playbooks, and workflow automation. Railtor is a technology platform and does not provide real estate brokerage, legal, tax, or financial advisory services.

3. No Professional Advice; Informational Only

The Service does not provide legal, tax, financial, investment, or real estate brokerage advice. All content and outputs are for general educational and informational purposes only. You should not rely on the Service as a substitute for advice from qualified professionals. Any decisions you make based on the Service are solely your responsibility.

Railtor is not a real estate broker. We do not represent buyers or sellers in real estate transactions. Nevada Real Estate License: NV S.0198730 (for informational purposes only). Consult licensed real estate professionals, attorneys, CPAs, and financial advisors before making any real estate or financial decisions.

4. User Conduct

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Upload or transmit viruses, malware, or harmful code
• Use the Service to generate content that violates applicable laws
• Share account credentials with unauthorized users

5. Intellectual Property

All content, features, and functionality of the Service are owned by Railtor and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without express written permission.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RAILTOR AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION: LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSSES; DAMAGES ARISING FROM YOUR USE OF OR RELIANCE ON AI-GENERATED OR AUTOMATED OUTPUT; ERRORS, MISTAKES, INACCURACIES, OR OMISSIONS IN ANY CONTENT; OR ANY DECISIONS YOU MAKE BASED ON THE SERVICE.

IN NO EVENT SHALL RAILTOR'S AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO RAILTOR IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). IN JURISDICTIONS THAT DO NOT PERMIT LIMITATION OF LIABILITY TO THE FULL EXTENT ABOVE, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. RAILTOR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, ACCURATE, COMPLETE, OR FREE OF HARMFUL COMPONENTS.

YOU USE THE SERVICE AND ANY OUTPUT AT YOUR OWN RISK. RAILTOR DISCLAIMS ALL LIABILITY FOR ANY LOSS OR HARM RESULTING FROM YOUR USE OF OR RELIANCE ON THE SERVICE.

8. AI and Automation Disclaimers

The Service uses artificial intelligence, machine learning, and automated tools. You acknowledge and agree that:

• AI can make mistakes. Outputs may be inaccurate, incomplete, outdated, biased, or otherwise erroneous. AI may “hallucinate” or generate plausible-sounding but false or misleading content.
• No reliance. You must not rely on AI-generated or automated output for any legal, financial, real estate, medical, or other professional or high-stakes decisions. Always verify important information with qualified, independent sources.
• Your responsibility. You are solely responsible for reviewing, verifying, and deciding how to use any output from the Service. Railtor is not responsible for any actions you take or decisions you make based on the Service.
• No guarantee of results. We do not guarantee that the Service will meet your needs, produce any particular result, or be suitable for any purpose. Past or sample outputs do not guarantee future performance.

By using the Service, you accept that AI and automation are imperfect and that you use them at your own risk. Railtor shall have no liability for any claim arising from AI-generated or automated content, including errors, omissions, or your reliance thereon.

9. Indemnification

You agree to indemnify and hold harmless Railtor and its affiliates from any claims, damages, losses, or expenses (including attorneys' fees) arising from your use of the Service or violation of these Terms.

10. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Nevada, without regard to conflict of law provisions. Any dispute shall be resolved through binding arbitration in Las Vegas, Nevada, except that either party may seek injunctive relief in court.

11. Changes to Terms

We may modify these Terms at any time. Changes will be effective upon posting. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
